1. Who we are & our two roles
SimpleAgentRE (“we,” “us”) provides a software-as-a-service portal for real estate agents and brokers in Texas. This Privacy Policy explains how we handle personal information in two distinct situations:
- As a business (data controller) — for the personal information of the agents and brokers who subscribe to and use our software. We decide how that information is used, and this policy governs it.
- As a service provider (data processor) — for the personal information of consumers (the buyers and sellers) that subscribing agents enter into the portal. For that data, the agent or brokerage is the controller; we only process it on their instructions under our Data Processing Agreement. We do not use consumer data for our own marketing and we do not sell it.
2. Information we collect
Account & subscriber information (agents/brokers)
- Name, brokerage name, and real estate license details
- Email address and phone number
- Login credentials (passwords are stored hashed, not in plain text)
- Billing and payment information — processed by our payment provider; we receive limited confirmation data and do not store full card numbers
- Profile and brokerage settings you enter
Usage & technical data
- Login times, pages and features used, clicks, and similar platform-usage data
- Device, browser, and IP address; basic log and diagnostic data
- Cookies and similar technologies used to keep you signed in and remember preferences (e.g. your selected theme)
Content you upload
- Client records, valuations/CMAs, transaction sheets, documents, and forms you create or store. Where these contain consumer personal information, we handle them as a processor (see §1).
3. How we use information
We use subscriber and usage information to:
- Provide, operate, secure, and maintain the portal and your account
- Process subscriptions, payments, and renewals
- Provide customer support and respond to your requests
- Improve and develop features, troubleshoot, and monitor performance and abuse
- Send service and administrative messages (and, where permitted, product updates you can opt out of)
- Comply with law and enforce our Terms of Service
We process consumer content only to provide the service to the agent and as instructed by them.
4. How we share information
We do not sell personal information. We share it only with service providers who help us run the platform, under contracts that limit their use of the data, and where required by law. Categories of third parties:

We may also disclose information to comply with legal process, protect rights and safety, or in connection with a merger, acquisition, or sale of assets (with notice where required).
5. MLS / IDX & public records data
Our tools may display or incorporate listing data from the Multiple Listing Service (MLS), IDX feeds, and public records to support valuations and listings. We use this data in accordance with applicable real estate commission rules, the operating rules of the relevant MLS, and IDX display guidelines. MLS/IDX content remains subject to the source provider’s terms, and we display or refresh it only as those rules permit.
6. Automated tools & AI (the CMA)
The portal includes a Comparative Market Analysis (CMA) and may include other automated or AI-assisted features. Where these are used:
- Property and comparable data you provide or that is pulled from MLS/public records may be sent to our AI provider, [AI PROVIDER], to generate analysis or draft content.
- Output is an estimate to support the agent’s own professional judgment. A CMA is not an appraisal and is not a guarantee of value. No fully automated decision producing a legal or similarly significant effect on a consumer is made by the tool — a licensed agent reviews and is responsible for the result.
- We do not use consumer personal information entered by agents to train our own or third-party AI models, except as needed to deliver the requested output.
7. Consumer data & privacy-rights requests
Consumers (buyers/sellers) interact with the agent, not directly with us. Because the agent is the controller of that data, consumer privacy requests — such as the right to access, correct, or delete information (e.g. under the CCPA/CPRA, the Texas Data Privacy and Security Act, or the GDPR where applicable) — should be directed to the agent or brokerage who holds the relationship.
The portal provides agents with tools to view, export, and permanently delete a client’s records so they can fulfill those requests, and we assist agents in responding as described in our Data Processing Agreement. If a consumer contacts us directly, we will refer them to the relevant agent/brokerage and assist that agent as the processor.
8. Data retention & deletion
We retain subscriber account information for as long as your subscription is active and as needed for legal, tax, and accounting purposes. Client and transaction content is retained while your subscription is active. After cancellation, we retain your data for [RETENTION DAYS] days to allow reactivation and export, after which it is permanently deleted from active systems (with backups expiring on their normal cycle). You may request earlier deletion as described in §10 and the DPA.
9. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit, access controls, hashed passwords, and regular backups. No method of transmission or storage is completely secure; we cannot guarantee absolute security. Our breach-notification commitments to subscribers are described in the DPA.
10. Your choices
- Access/update: review and edit your profile and account information in the portal, or contact us.
- Deletion: request deletion of your account and associated data.
- Marketing: opt out of non-essential email at any time.
- Cookies: control cookies through your browser; some features may not work without them.
11. Children
The portal is a business tool intended for licensed real estate professionals and is not directed to children under 16. We do not knowingly collect personal information from children.
12. Changes & contact
We may update this policy from time to time. Material changes will be posted here with a new “Last updated” date and, where appropriate, communicated to subscribers. Questions or requests:
